THIS AGREEMENT is made and entered between CANDYWORLD USA, and the Customer, who wishes to place orders on our homepage a.k.a. BELGIAN CHOCOLATE ONLINE ® Inc.- a Division of CANDYWORLD USA ® Inc.
NOW, THEREFORE, in consideration of the foregoing premises and the mutual covenants hereinafter set forth, the parties hereto agree as follows:
ONLINE ORDERING SECURITY
Belgian Chocolate Online transaction frames are fully SSL encrypted and all information is sent securely.
The minimum of an order is $25.00 pro order (cool box or other packaging not included).
SSL encryption ensures that transaction information is sent securely but has a significant performance tradeoff in the browser environment. You may have noticed that the Belgian Chocolate Online site employs a framed metaphor for easier navigation and more efficient page updates. With this in mind Belgian Chocolate Online selectively places SSL encryption on only those forms and frames that need to be encrypted (i.e. the checkout). Since things like our section selectors and menus don't need to be slowed down by SSL we do not employ it there.
Unfortunately browsers won't show the safe "KEY" or "LOCK" unless each and every frame on the page is SSL encrypted. Thus, if only one frame is encrypted, the browser correctly reports that not everything you are looking at is "safe". However, the absence of the "lock" or "key" does not mean that the information you are looking at is not encrypted.
You can verify that a frame is SSL encrypted by right-clicking within the frame and looking at the frame info or properties (i.e. found in the "View" menu in Netscape and the "File" menu in Internet Explorer). Doing this within Belgian Chocolate Online checkout pages will indeed show that this information is being sent encrypted and thus any security concerns you may have should be relieved.
Shipping/Handling Policy:
SHIPPING COSTS (PER RECIPIENT)
Please read the Shipping Costs on the Shopping Cart before placing the order.
All shippings are insured by USPS or UPS on behalf of the Customer and it will be done following the internal carriers's Rules and Regulations to be charged on the Customer's account.
If shipped otherwise, s.a. UPS or other carrier, and if shippings has to be insured, it will be done throug the carrier, following their internal rules and Regulations.
All shippings and Insurances are paid by the purchaser, and the refund after loss will go the the Purchaser of the shipped goods.
At the checkout the customer has the possibility to make a choice for UPS or USPS shipping insurance at the carrier's regular insurance rate to cover the entire shipping.
Unfortunately, USPS packages cannot be tracked because it does not offer tracking. The numbers for the post office are Delivery Confirmations which update on the date first delivery is attempted.
"Candyworld USA Inc. / Belgian Chocolate Online" is not responsible for lost, stolen, or otherwise missing packages shipped via any Carrier.
Items shipped with any carrier without any insurance is at customer's risk.
There is no Saturday, Sunday or Holiday pick up or delivery. We only ship in the Continental USA and the prices are for the continental USA only. Some exceptions for shipping abroad are available.
Delivery Times
Belgian Chocolate Online / Candyworld USA only accepts and ships orders to the continental United States, Puerto Rica, Alaska and Hawaii. We cannot ship to APO,FPO or P.O. box addresses.
Order delivery time is based on availability and shipment option as well as processing time.
Please note our warehouses do not ship on weekends and Holidays.

Return Authorization Policy: (Wholesale Only)
Return authorization is always required.
The fastest way is by email. Simply email us the following information:
- Your full name, address and phone number (day and evening)
- The name and address the merchandise was shipped to
- The item(s) you wish to return/exchange and the reason(s) for the return/exchange.
WARNING: DO NOT just return an item without emailing us the above information! We need to give you the correct address to return your item(s) to!
We will contact you within 24-48 hours by phone or email and give you the proper instructions and the correct address where to send your return!
Following these procedures will result in a smooth and painless transaction, and speed up your refund or exchange considerably!

Shipping rates are based on method, weight, and distance from Philadelphia, PA. You can estimate shipping costs by using our shipping calculator, accessible from your shopping cart. Shipping charges can be calculated prior to checkout.
After you have filled your shopping cart, click the Details link located below your items in the left navigation pane. Your shopping cart details will appear, displaying all your chosen items. Click the Calculate Shipping link and you will see a window for a zip code. Enter your zip code, click the Calculate button, and all available shipping options will appear.

Hospital / Hotel Delivery:
Deliveries to hospitals and hotels are not recommended. These shipments normally go to a general receiving department before being routed internally to the patients and/or guest rooms; Therefore, we do not guarantee hospital/hotel deliveries. Sorry, no refunds will be given if the patient and/or guest checks out or cannot be located.
Payments
Some times we don’t accept international credit cards, or credit cards of billing addresses outside the USA, (check with the your credit card issuer if this occurs).
If we did not ship your package, it is because we couldn’t get the proper authorization from your credit card company for your order. We advice you to contact customer service for clarification, in this case.
Wrong Addresses:
Orders sent to a wrong or incomplete address are not guaranteed. Additional fees apply to fix and forward the package to the correct address.
In the event that a package is undeliverable due to a wrong address (given by the Customer) and send back to the shipper (Candyworld USA Inc.) the Customer will be credited to his/her credit card in the amount of the goods paid. Shipping and handling are not refundable.
The restocking fees are as follows:
The Restocking fee is in the amount of 10% of the total purchase with a minimum of $15
* For all special orders and offers, all sales are final.
All pieces must be returned in original condition with original packaging, and received by Belgian Chocolate Online / Candyworld USA Co within the defined return period. If any damages to the products the return will be void and returned to the customer and charged for the returned shipped. Shipping and handling are not refundable.
Undelivered Packages:
Once a delivery attempt has been made it is the responsibility of customer to make sure the package is accepted. We do not guarantee delivery will be made if there is no one home to accept a package or if the Carrier (UPS, USPS, FEDEX or other Carrier) is unable to deliver a package. Some packages require a signature, while others may be left at the door.
If a Package is Returned:
If a package is returned after the 10 business days, no refunds will occur.
Because chocolate is a perishable food item and if we determine there was no fault on Candyworld USA / Belgian Chocolate Online's side and product is returned damaged in any way, we reserve the right to not refund the customer any of their money.
Refund Dispute:
Any credit charge that is disputed and Candyworld USA Inc./Belgian Chocolate Online is not found at fault, and that Seller has done its best according to its policies, will have a $25.00 fee assessed to the customer to cover a merchant service chargeback fee. The $25.00 is a fee that is charged to Candyworld USA Inc./Belgian Chocolate Online by the processing bank.
Missing/Damaged Item:
1.If you have a damaged item (not melted or bloomed) and you like to be reimbursed for it you MUST first contact UPS at 1-800-742-5877 or USPS and then contact us at 1-800-735-4381 within 24 hours of the delivery. Please have your tracking number ready before you contact UPS. Candyworld USA would credit your account for the amount of the broken (not melted or bloomed) item or would ship it at no additional cost for you.
2. If you have a missing item please contact us at 1-800-735-4381 within 24 hours of the delivery. You would have the following options: refund for the amount of the missing item or receiving the missing item with your next order with no shipping charge for the missing item.
Return Policy:
CLAIMS FOR DAMAGES.
All merchandises leaves the business in perfect condition. It then becomes the BUYER'S RESPONSABILITY to claim for damages with the delivering carrier.
Upon return of the product(s) due to Customer's refusal to accept the order or wrong address, Candyworld USA, Inc. will issue a credit to the Customer's account in an amount equal to the value of the product(s). Shipping charges and surcharges, as well as special services are not refundable unless product(s) are damaged and/or defective.
The Carrier's Insurance doesn't cover the melting or blooming (whitening) of the chocolates in any way.
No return of food is accepted, under any circonstances.
BELGIAN CHOCOLATE ONLINE cannot be held responsible for damage if you (or the recipient of a gift) are not present at time of delivery and the damage occurs as a result of the delay in claiming the package.
Also, BELGIAN CHOCOLATE ONLINE cannot be responsible for heat damage.
We highly recommend shipping to an address where someone will be able to receive the package when delivered.
Chocolate left outside your home may be damaged by weather that is too hot, cold, rainy or humid.
